اعضاء بعمومية الهلال يتقدمون بطعن ضد تعيين الكاردينال لرئاسة لجنة التطبيع

تقدم أعضاء بالجمعية العمومية لنادي الهلال بطعن لدى الإتحاد السوداني لكرة القدم ضد ترشيح السيد/أشرف سيد أحمد حسين (الكاردينال) لرئاسة لجنة التطبيع الهلالية المزمع تكوينها

وفيما يلي تنشر (Sudan2day) نص الطعن :

السادة رئيس واعضاء لجنة الطوارئ بالاتحاد السوداني لكرة القدم.

الموضو: لجنة التطبيع لنادي الهلال للتربية

بالإشارة الى الموضوع اعلاه فقد شرعت لجنتكم الموقرة في تعيين لجنة تطبيع لنادي الهلال للتربية (ام درمان) بعد انتهاءامد المجلس المنتخب.

نثمن اهتمامكم الكبير بسد الفراغ الاداري بالنادي والعمل علي تحقيق الاستقرار والتوافق المنشود علي يد اللجنة المزمع تعيينها.

ولكننا نود أن نشير الى أن تعيين السيد/اشرف سيد احمد حسين رئيساً لهذه اللجنة يخالف ضوابط وموجهات الاتحاد الدولي لكرة القدم (فيفا) فيما يتعلق بفحص النزاهة والأهلية لكل المتقدمين لشغل المناصب في اجهزة الاتحاد الوطني واعضاءه.

ومما لا شك فيه أن لجان التطبيع التي يعينها الاتحاد ويمنحها الشرعية ويحدد لها اختصاصاتها وأمدها تعتبر بذلك اجسام تابعة له مباشرة وبالتالي ينطبق علي اعضاءها ما ينطبق على اعضاء مجلس ادارة الاتحاد من متطلبات الأهلية والنزاهة.

وقد اكد (فيفا) علي ذلك في لائحة الانتخابات الخاصة بالاتحاد السوداني والصادرة من (فيفا) في يوليو ٢٠٢٠
(Electioal code of SFA )
في القسم “1” من الملحق (أ) والتي تنص على الآتي:

The integrity checks with regard to candidates for, and holders of, official positions within SFA that are subject to such checks (”candidates or holders”) shall be conducted by the relevant body in accordance with the provisions of this Code and annexe.

Candidates or holders are obliged to comply with the screening and self-disclosure process as outlined in parts 2 and 3 below.

Prior to the screening process, every candidate or holder shall give his written consent to said process through a form provided by the relevant body conducting the integrity check.

If such written consent is not provided, the candidate or holder shall be deemed not to have passed the integrity check.

Candidates or holders shall act in good faith at all times and shall fully collaborate to establish the relevant facts upon reasonable notice.

If the candidate or holder concerned does not cooperate with the body competent to conduct the integrity check, the candidate or holder shall be deemed not to have passed the integrity check.

The candidate or holder shall be deemed not to have passed the integrity check, if he:

a) has been subject to criminal convictions or disciplinary sanctions by a state court, in particular if the offence in question was a substantive issue and not a minor infraction or procedural misconduct;

b) has been found guilty and/or sentenced by the FIFA Ethics Committee or any other sporting body with a sanction that would seriously put into question the discharge of the office concerned.
Subject to the relevant provisions regarding disclosure and forwarding of the information and related data obtained in the context of integrity checks in accordance with this annexe, all such information and related data must be treated as strictly confidential by the body conducting the integrity check concerned.

These “lighter” eligibility checks have been conducted on members of normalisation committees installed by FIFA as well as candidates for FIFA’s Dispute Resolution Chamber.

In addition, it is considered that confederations may also choose to conduct such “lighter” eligibility checks on candidates for positions that are neither high-ranking nor in independent committees.

Furthermore, such checks could also be conducted by member associations on candidates for positions within their organisation.

واستناداً علي المادة( ٢ )فقرة ٦ والمادة (٧) الفقرة ٢ من النظام الاساسي للاتحاد السوداني لكرة القدم.

وحيث ان المذكور قد سبق ادانته في جريمة تمس الامانة الامر الذي يؤكد عدم أهليته وإخفاقه مسبقا في اجتياز إختبار النزاهة المطلوب استناداً الى نص اللائحة اعلاه.

بناءا عليه، نطلب من سيادتكم الاتي:

١/ إبعاد السيد/اشرف سيد احمد حسين من قوائم لجنة التطبيع لنادي الهلال للتربية.
